Terms of Service

These Terms of Service govern access to and use of the RentFAX website, platform, APIs, consumer portal, reports, workflows, and related services. By accessing or using the Services, you agree to these Terms.

1. Definitions

“RentFAX,” “we,” “our,” and “us” mean RentFAX. “Services” means the RentFAX website, platform, APIs, consumer portal, reports, workflows, and related offerings. “Operator” means a vehicle-rental business or other approved subscriber that uses the Services. “User” means any person who accesses or uses the Services. “Consumer” means the individual who is the subject of information maintained or furnished through the Services.

2. Scope of Services

RentFAX provides consumer-reporting and related workflow services for vehicle-rental screening and other lawful vehicle-rental uses. Certain services may also be governed by separate subscriber agreements, order forms, API terms, or other written agreements. If there is a conflict between these Terms and a signed subscriber agreement, the signed subscriber agreement will control to the extent of the conflict.

3. Permitted Use

The Services may be used only for lawful vehicle-rental purposes authorized by RentFAX and applicable law. The Services may not be used for:

• employment screening
• volunteer screening
• tenant or housing screening
• mortgage or lending decisions
• credit underwriting
• insurance underwriting
• marketing or solicitation
• resale, republication, or unauthorized redistribution of report information
• any unlawful or impermissible purpose

4. Eligibility and Account Access

You may use the Services only if you are legally authorized to do so and, where applicable, are acting on behalf of an approved Operator. You are responsible for maintaining the confidentiality of your login credentials, restricting access to authorized personnel only, and ensuring all activity under your account complies with these Terms and applicable law. You must notify RentFAX promptly if you suspect unauthorized use of your account or credentials.

5. Subscriber Certifications

Operators must certify that each report request is supported by a lawful permissible purpose and any required consumer consent or authorization. RentFAX may require transaction-level certifications, account-level certifications, user-level attestations, and supporting records or audit confirmations. RentFAX may suspend or deny access if certifications are incomplete, inaccurate, inconsistent, or unreliable.

6. Consumer Reporting Context

Certain information furnished through the Services is a consumer report or otherwise subject to consumer-reporting laws. Users must comply with all applicable laws governing access, use, confidentiality, adverse action, redisclosure, retention, and consumer rights. Nothing in these Terms authorizes any use of the Services that is prohibited by law.

7. Operator Responsibility for Decisions

Operators make their own rental decisions. RentFAX does not approve, deny, recommend, or guarantee any rental transaction. If an Operator takes adverse action based in whole or in part on information furnished by RentFAX, the Operator is solely responsible for making the decision, determining whether notice is required, delivering any required notice, and maintaining records relating to that decision.

8. Consumer Rights and Requests

Consumers may have rights under applicable law to request access to information about themselves, dispute inaccurate or incomplete information, and receive other notices or disclosures required by law. RentFAX may require reasonable identity verification before responding to any such request.

9. Data Use Restrictions

Users may not scrape, mine, harvest, or systematically extract data from the Services; use report information outside the specific approved workflow or transaction; share report information with persons who do not have a legitimate need to know; create unauthorized derivative products from report data; use the Services to profile, rank, or target individuals for unauthorized purposes; or interfere with, test, or bypass security controls.

10. Furnished Information

If you furnish information to RentFAX, you represent and warrant that the information is accurate, complete, timely, lawfully collected, supported by business records, and furnished in compliance with applicable law. You agree to cooperate promptly with dispute investigations, substantiation requests, and correction efforts.

11. Security Obligations

Users must maintain reasonable administrative, technical, and physical safeguards to protect report information, account credentials, and any data received through the Services. Users must notify RentFAX promptly of suspected misuse of reports, unauthorized access to credentials, security incidents involving RentFAX data, or suspected impermissible use by personnel or third parties.

12. Monitoring, Suspension, and Termination

RentFAX may monitor usage patterns, certifications, and security indicators to protect the Services and comply with legal obligations. RentFAX may suspend, restrict, or terminate access immediately if it reasonably believes there is impermissible use, false certification, misuse of report information, legal or regulatory risk, security risk, unresolved consumer-complaint patterns, or breach of these Terms or applicable law.

13. Intellectual Property

The Services, including software, designs, text, graphics, reports, trademarks, branding, workflows, and documentation, are owned by RentFAX or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted in writing, no right, title, or license is granted to any user.

14. No Guarantee of Outcome

RentFAX does not guarantee any particular rental, fraud-prevention, operational, financial, or business outcome. Information furnished through the Services is one input into a lawful operator review process.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as available” and “as offered” basis. Except where prohibited by law, RentFAX disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Nothing in these Terms limits any non-waivable obligations imposed on RentFAX by applicable consumer-reporting, privacy, security, or other laws.

16. Limitation of Liability

To the fullest extent permitted by law, RentFAX shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunity, loss of goodwill, or business interruption arising out of or relating to the Services. To the fullest extent permitted by law, RentFAX’s aggregate liability arising out of or relating to the Services shall not exceed the total amount paid by the user to RentFAX for the Services during the twelve-month period preceding the event giving rise to the claim. This section does not apply to the extent a limitation of liability is prohibited by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless RentFAX and its officers, directors, employees, and agents from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Services, unlawful report requests, false certifications, inaccurate furnished data, unlawful adverse action, unauthorized redisclosure, breach of these Terms, or violation of applicable law.

18. Governing Law

These Terms are governed by the laws of the State of New York, except to the extent federal law controls or preempts.

19. Changes to the Services or Terms

RentFAX may modify the Services or these Terms from time to time. If we update these Terms, we will post the revised version with a new effective date. Continued use of the Services after the new effective date constitutes acceptance of the updated Terms.
